This Agreement contains crucial information regarding your rights, obligations, conditions, limitations, and exclusions that apply to your access and use of our Discord bot, its website, dashboard, and other related services (collectively referred to as "Service" or "Platform").

By accessing or using the Service, including by adding Marvo to your server, you agree to be bound by this Agreement. By adding Marvo to your server, you acknowledge and consent to all terms outlined in this Agreement, which includes our Terms of Service and Privacy Policy.

We reserve the right to update this Agreement to ensure legal compliance or enhance the Service. Before implementing any changes, a 14-day notice will be provided, and the notice will be posted on our official support Discord server ("Support Server") located at https://discord.gg/DhDxz9E. Your continued use of the Service after the changes are implemented will be considered as your acceptance and agreement to the revised terms.

Usage of the Service in violation of Discord's terms or for illegal purposes is strictly prohibited. If you encounter individuals or communities utilizing Marvo in violation of Discord's terms or engaging in illegal activities, please immediately report such instances to [email protected] or on our Support Server.

1. About the Service

Marvo is a versatile Discord bot designed to enhance Discord servers. Our mission is to provide users with powerful tools and features to streamline server management and engagement within a Discord community, without the need for a lot of bots.

We want to emphasize that Marvo operates independently and is not affiliated with or endorsed by Discord in any capacity. While Marvo integrates with Discord's platform to provide its services, it is a separate entity developed and maintained by us. This means that any interactions, transactions, or activities conducted through the Platform are solely our responsibility and are not endorsed or supported by Discord. Our team is solely responsible for the development, maintenance, and support of the Platform, and any inquiries or issues related to its functionality should be directed to us.

Marvo strictly operates within the bounds outlined in Discord's Developer Policy and Developer Terms of Service. We are committed to providing a safe, secure, and reliable service to our users.

In the event that any provision of this Agreement conflicts or is inconsistent with the terms and conditions set forth by Discord in its Developer Terms of Service or any other agreement, the terms and conditions provided by Discord shall supersede and govern over such conflicting provisions of this Agreement.

USERS ARE STRICTLY PROHIBITED FROM USING OUR SERVICE IN A MALICIOUS WAY. THIS INCLUDES, BUT IS NOT LIMITED TO, ANY ATTEMPTS TO HARM THE INTEGRITY, FUNCTIONALITY, OR REPUTATION OF DISCORD OR ITS USERS. SUCH MALICIOUS ACTIVITIES MAY INCLUDE SPAMMING, PHISHING, HACKING, DISTRIBUTING MALWARE, ENGAGING IN HARASSMENT OR ABUSE, OR ANY OTHER ACTIONS THAT VIOLATE DISCORD'S TERMS OF SERVICE. ANY USERS FOUND ENGAGING IN SUCH ACTIVITIES WILL BE SUBJECT TO IMMEDIATE AND PERMANENT TERMINATION OF THEIR ACCESS TO OUR SERVICE, AND MAY BE REPORTED TO DISCORD FOR FURTHER ACTION.

2. Restrictions on your use of Marvo's services

While we strive to provide a versatile and user-friendly service, there are certain restrictions on how you may use Marvo's services. By accessing or using the Service, you agree not to engage in any of the following prohibited activities:

This includes not using Marvo's services to distribute or transmit any content that you do not have the legal right to use.

5. Impersonation: You agree not to impersonate any person or entity, or to falsely represent your affiliation with any person or entity, while using Marvo's services. This includes not using Marvo to impersonate other users or to engage in any fraudulent or deceptive activities.

6. Illegal or Harmful Activities: You agree not to use Marvo's services for any illegal or harmful activities, including but not limited to activities that are fraudulent, deceptive, or harmful to others. This includes not using Marvo to promote or facilitate illegal activities or to harm others in any way.

7. Responsibility for User-generated Content: You acknowledge and agree that Marvo is not responsible for the content of any messages or communications sent or received using the Service. You are solely responsible for the content of your messages and for ensuring that they comply with all applicable laws and regulations. 8. Compliance with Discord's Terms: You agree to use Marvo's services in compliance with Discord's Terms of Service, as well as any other applicable terms or policies established by Discord, including, but not limited to, the Community Guidelines located at https://discord.com/guidelines. You acknowledge that Marvo is not endorsed or supported by Discord, and that your use of Marvo's services is subject to Discord's terms and policies.

3. Usage of Publicly Available Data

By using our platform, you acknowledge and agree that certain data, including but not limited to publicly available information from your Discord server and account, may be collected and used by us for various purposes. This data may include, but is not limited to server ID, member IDs, and other publicly available information accessible through Discord's API or other means.

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display any brand features or publicly available data associated with your Discord server for the purpose of providing and improving our services, promoting our platform, and complying with legal obligations. However, we will not use your brand features or publicly available data in a way that suggests endorsement, sponsorship, or affiliation with your server without your explicit consent.

You retain all ownership rights to your brand features and publicly available data. This license does not grant us any ownership rights to your brand features or publicly available data, except for the limited rights necessary to operate and improve our platform.

If you do not wish for your brand features or publicly available data to be used in accordance with this section, please refrain from using the Service.

4. Availability

The Service is provided on an 'as is' basis. We make no guarantees regarding the availability, reliability, or functionality of the Service. While we strive to maintain high availability and reliability, we cannot guarantee that the Service will be uninterrupted, timely, secure, or error-free.

We reserve the right to modify, suspend, or discontinue all or any part of the Service at any time, with or without notice. This includes, but is not limited to, changes to features, functionality, or availability of the Service. 5. User-generated Content

The Service may allow you to upload, submit, store, send, or receive content, including but not limited to files, images, text, audio, or video ("User-generated Content"). You acknowledge and agree that any User-generated Content you provide is your sole responsibility.

You retain all rights to your User-generated Content, and by uploading or submitting such content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User-generated Content solely for the purpose of providing and improving the Service.

You agree not to upload, submit, or transmit any User-generated Content that violates any applicable laws, infringes upon the rights of others, or is harmful, defamatory, obscene, offensive, or otherwise objectionable. We reserve the right to remove or disable access to any User-generated Content that violates this Agreement or is deemed inappropriate at our sole discretion.

WE ARE NOT RESPONSIBLE FOR ANY USER-GENERATED CONTENT UPLOADED OR SUBMITTED BY USERS OF THE SERVICE. YOU ACKNOWLEDGE AND AGREE THAT YOU MAY BE EXPOSED TO USER-GENERATED CONTENT THAT IS INACCURATE, OFFENSIVE, INDECENT, OR OBJECTIONABLE, AND YOU WAIVE ANY RIGHTS OR REMEDIES AGAINST US IN CONNECTION WITH SUCH CONTENT.

WE ARE NOT LIABLE FOR ANY USER-GENERATED CONTENT UPLOADED OR SUBMITTED TO OUR BACKEND SYSTEMS. WE DO NOT ENDORSE OR CONTROL USER-GENERATED CONTENT, AND WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, INTEGRITY, OR QUALITY OF SUCH CONTENT.

If you believe that your User-generated Content has been used in a manner that constitutes copyright infringement or other violation of your rights, or if you encounter User-generated Content that violates any applicable laws or this Agreement, please contact us at [email protected] for assistance immediately.

6. Feedback

We welcome and appreciate any feedback you may have regarding Marvo's services. By providing us with feedback, suggestions, or ideas ("Feedback"), you grant us a non-exclusive, perpetual, irrevocable, royalty-free license to use, modify, adapt, publish, translate, distribute, and display the Feedback for any purpose without compensation to you.

You acknowledge that any Feedback you provide will become the sole property of Marvo and may be used by us for product improvements, enhancements, or marketing purposes. If you do not wish to grant us these rights, please do not provide us with any Feedback.

Additionally, any Feedback provided by you must not violate any third party's rights, including intellectual property rights, and must not contain any confidential or proprietary information of third parties. We reserve the right to review, edit, or remove any Feedback that we deem inappropriate or in violation of this Agreement.

7. Refund Policy

• 7.1. Eligibility

  All users are eligible for a refund for eligible purchases made through our Platform, provided that the refund request is submitted within 3 days of the purchase date and complies with all applicable laws and regulations.

• 7.2. Refundable Items

  All subscriptions are eligible for a refund upon request. Refund eligibility for other virtual goods, such as cosmetic items, currency, or items, may vary and will be determined on a case-by-case basis at our sole discretion.

9. Indemnity and Liability

You agree to indemnify and hold Marvo, its affiliates, and its team members harmless from any claims, damages, liabilities, costs, or expenses (including attorneys' fees) arising out of or related to your use of the Service, your User-generated Content, or your violation of this Agreement.

Marvo, its affiliates, or its team members shall not be liable to you or any third party for any indirect, consequential, incidental, special, punitive, or exemplary damages arising from or related to your use of the Service. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.

This limitation of liability shall apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise, and shall survive termination of your access to the Service.

10. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Germany, excluding its conflict of law principles. Any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts located in Germany.

11. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable under any applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable while preserving the original intent of the provision. If such modification is not possible, the invalid provision shall be deemed severed from this Agreement, and the remaining provisions shall continue in full force and effect.
